1. Publisher and Purpose
These General Terms and Conditions (hereinafter "GTC") govern the sale of subscriptions for the school management software Zaame, published by:

Zaame is an online application designed for educational institutions to manage their administrative, educational, and financial activities.
2. Acceptance of Terms
Any subscription purchase or use of the application implies the Customer's unreserved acceptance of these GTC.
3. Subscription Plans
- Subscriptions are billed per academic year.
- The subscription expires automatically on the scheduled expiration date and does not renew automatically.
- No refunds are possible after the purchase of a subscription, regardless of the reason provided.
- A "Free for Life" plan is available for testing the application. This plan offers limited access in terms of features and/or number of users. These limitations may be modified by the Publisher at any time without prior notice.
4. Ordering and Payment
- 4.1 Zaame Platform Subscriptions
Subscription orders are placed online via the official website or directly through the sales team. Payment is required at the time of order. Accepted payment methods are:
- - Credit/debit card (Visa, Mastercard) via PayPal
- - PayPal (PayPal account or credit card)
- - Mobile Money via PawaPay (MTN Mobile Money, Orange Money, Airtel Money, M-Pesa, Vodacom M-Pesa, Free Money, Moov Money, Zamtel) depending on geographic coverage
- An invoice is issued upon payment confirmation. The payment provider is automatically suggested based on the institution's location.
- 4.2 Online School Payments (Tuition Fees)
- Zaame provides educational institutions with an online school payment collection feature (tuition fees, registration fees, miscellaneous charges), enabling parents and guardians to pay directly through the application.
- a) Zaame's Role as a Technical Intermediary:
Zaame acts solely as a technical intermediary between the educational institution and the payment providers. Zaame does not collect, hold, or transfer funds. Payments are processed directly by the payment provider chosen and configured by the institution, and funds are settled directly into the institution's account.
b) Available Payment Providers:
Depending on the institution's country, the following providers are available: Geographic Zone Provider Payment Methods Europe, North America, Australia Stripe Credit/debit card Francophone West Africa (CI, SN, TG, BJ, ML, CM, GN, BF) CinetPay Mobile Money, local cards Sub-Saharan Africa (CD, CG, GA, RW, UG, TZ, ZM, MW, MZ, SL) PawaPay Mobile Money Nigeria, Ghana Paystack Credit card, bank transfer, Mobile Money, USSD Egypt Fawry / PayMob Local cards, Fawry payments, digital wallets Kenya Pesapal M-Pesa, credit card, bank transfer South Africa PayFast Credit card, EFT, wallets - c) Institution's Responsibility:
The institution is solely responsible for: - Creating and verifying its account with the payment provider
- Entering and maintaining valid API keys and credentials
- Complying with the chosen provider's terms and conditions
- Tax and regulatory compliance for payments received in its country
- d) Transaction Fees:
Transaction fees are charged directly by the payment provider to the institution. Zaame does not charge any additional commission on school payments collected.
4.3 Liability Regarding Online Payments
a) Zaame does not guarantee the availability, speed, or success of transactions processed through third-party payment providers. In the event of a provider failure, Zaame shall not be held liable for any delays, errors, or financial losses. - b) Any dispute relating to a school payment (amount, refund, chargeback) shall be resolved directly between the institution, the parent/guardian, and, where applicable, the relevant payment provider.
- c) Zaame reserves the right to suspend an institution's online payment feature in the event of fraudulent, abusive, or non-compliant use under these Terms.
- d) The institution undertakes to inform its parents/guardians of the available payment methods and any applicable transaction fees.
5. Customer Obligations
The Customer agrees to:
- Provide accurate information upon subscription.
- Use the application in compliance with applicable laws and regulations.
- Refrain from sharing login credentials with unauthorized third parties.
6. Access and Availability
The Publisher strives to provide access to the service 24/7, except during scheduled maintenance or cases of force majeure. In the event of an unforeseen interruption, the Publisher will implement all reasonable measures to restore the service promptly.
7. Liability
The Publisher shall not be held liable for any direct or indirect damages resulting from the use or inability to use the application, except in cases of proven negligence on its part.
8. Intellectual Property
The application, its source code, design, and content are protected by copyright law. Any unauthorized reproduction, modification, or distribution is strictly prohibited.
9. Personal Data Protection (GDPR)
In accordance with the General Data Protection Regulation (GDPR), collected data is processed solely to provide the service.
- The Customer has the right to access, rectify, delete, and request the portability of their data by writing to: [email protected].
- Data is retained for the duration necessary for the execution of the contract and in accordance with legal obligations.
In the context of online payments, banking and payment data (card numbers, Mobile Money identifiers) are never stored on Zaame's servers. Such data is processed exclusively by certified payment providers (Stripe, CinetPay, PawaPay, Paystack, Fawry, PayMob, Flutterwave, Pesapal, PayFast), in accordance with applicable PCI-DSS standards. - Zaame only retains transaction metadata (session ID, amount, status, date) required for tracking and accounting purposes.
10. Termination
- The Customer may terminate their subscription at any time; however, no refund will be issued for the remaining period.
- The Publisher reserves the right to terminate a subscription if the Customer fails to comply with these GTC.
11. Governing Law and Jurisdiction
These GTC are governed by Moroccan law. Any dispute shall be brought before the competent courts of Casablanca.
