General Terms of Use
1. Purpose
The purpose of these General Terms of Use (GTU) is to define the conditions under which BAYE Conception (the "Publisher") makes the Zaame application and its website available to Users (Institutions, Teachers, Students, Parents, Staff). Accessing and using the platform implies full and unreserved acceptance of these GTUs.
2. Access to the Service
- Institution: Access is created upon registration and subscription.
- Other Users: Accounts are created exclusively by the Institution.
- The Publisher strives to ensure access 24/7 but shall not be held liable for interruptions due to maintenance, technical failures, or cases of force majeure.
3. User Accounts and Security
- Each User is responsible for maintaining the confidentiality of their login credentials.
- Any unauthorized use of an account must be reported immediately to the Institution’s administration.
- The Publisher is not liable for data loss or damages resulting from the loss or misuse of passwords.
4. Rules of Conduct
Users agree to:
- Not use the platform to broadcast illegal, offensive, or harmful content.
- Not attempt to bypass security measures or disrupt the platform's integrity.
- Use the communication tools (Messaging, Forums) in a respectful and professional manner.
5. Intellectual Property
The Zaame application (source code, design, logos, and features) is the exclusive property of BAYE Conception. Users are granted a limited, non-transferable, and non-exclusive license to use the service for the duration of their subscription or affiliation with an institution.
6. Limitation of Liability
- Technical: The Publisher cannot be held liable for errors in data entry, network malfunctions, or compatibility issues with the User's hardware.
- Content: The Institution is solely responsible for the accuracy and legality of the data entered (grades, student records, personal information).
7. Personal Data and Privacy
The use of the application is subject to our Privacy Policy. By using Zaame, Users consent to the processing of their data in accordance with the GDPR and Moroccan data protection laws (Law No. 09-08).
8. Modifications
The Publisher reserves the right to modify these GTUs at any time to reflect changes in the service or legal requirements. Continued use of the platform after such modifications constitutes acceptance of the new terms.
9. Governing Law
These General Terms of Use are governed by Moroccan law. Any litigation relating to their interpretation or execution shall be subject to the exclusive jurisdiction of the courts of Casablanca.
